Is Portugal going to stop new Airbnbs?


Portugal will only suspend new Airbnb or short-term rental licenses in apartments and accommodation that are part of buildings located in popular areas along the coast, and this does not affect rentals in areas listed in the Annex to Ordinance No. 208/2017 for accommodation that is inland. In municipalities that are listed as having a housing shortage, it will not be possible to obtain an Airbnb or short-term rental license in all or part of the area of ​​the municipality in which there is a lack of supply. However, it will be possible to apply for an Airbnb or short-term rental license, “Alojamento local” in Portuguese, if the accommodation falls within the concept of interior territories as per Ordinance 208/2017.



Will people lose their Airbnb license in Portugal in 2023?


People who already have an Airbnb or short-term rental license in Portugal in 2023 will not lose it, but there are exceptions. The Airbnb or short-term rental license, called “Alojamento local” in Portuguese, is subject to evaluation in 2030 by each municipality and people may then lose their Airbnb license. The exception to this rule is in case the owner of the Airbnb license took out a loan to pay to convert their accommodation into an Airbnb, in which case there will be no license review if the owner obtained a loan before February 16th, 2023, as long as the loan was not fully repaid by December 31st, 2029.


It is important to note that condominiums in Portugal now have the power to deauthorize an Airbnb or short-term rental license. With the new law effective in Portugal in 2023, condominiums can terminate licenses that have already been issued without first obtaining their approval.


A condominium can deauthorize an Airbnb license that was already issued when the condominium notifies the relevant Municipal Council, and the license termination takes effect within 60 days after notification. The owner’s Airbnb license is then cancelled, and the owner is notified of the immediate cessation of his short-term rental activites.


In cases when the owners sell the property, the new owner will not be able to keep the Airbnb or short-term rental license. This is because the local establishment registration number is personal and non-transferable, except in cases of inheritance.


Will an Airbnb license be more expensive in Portugal?


An Airbnb or short-term rental license will be more expensive in Portugal, but only in the case of apartments and accommodation establishments that are integrated into an autonomous fraction of a local accommodation building. In these cases, Portugal created an extraordinary contribution of 15%, a CEAL contribution, which varies according to the operating income, the evolution of rents and the weight of Airbnb or short-term rentals in the area. The CEAL contributions are managed by the Institute of Housing and Urban Rehabilitation, that defines the area available for ​​housing, housing rentals and urban rehabilitation.



How do I get an Airbnb license in Portugal?


It is possible to get an Airbnb or short-term rental license in Portugal, called “Alojamento local” in Portuguese, as long as the accommodation is located in the interior of the country, subject to the concept of interior territories as per Ordinance 208/2017. The suspension for new Airbnb or short-term rentals may be lifted if it is in line with the Municipal Housing Charter that defines the appropriate balance of housing supply and student accommodation in the respective territory.


It is important to note that new Airbnb licenses can only be granted if the condominium unanimously authorizes it.



For how long will new Airbnb licenses in Portugal be granted?


New Airbnb or short-term rental licenses in Portugal will be granted for a period of five years, renewable for equal periods.
